1. Your access to and use of this Site is conditional upon your acceptance of and compliance with the Terms and Conditions of this document (“Terms and Conditions”) and shall be construed as you having entered into a binding agreement with Tupperware India Private Limited (“the Company”). By accessing and browsing this Site, you accept, without qualification or limitation, these Terms and Conditions.

2. This microsite is owned by Tupperware India Private Limited (Tupperware India) and has been designed for customers visiting our website. This website doesn’t facilitate placement of orders by the Customers directly on Tupperware India. Tupperware India has been permitted for undertaking only wholesale trading and is not engaged for the purposes of retail trading or online selling. The website has been developed with the purpose of providing the information of Tupperware products available for sale and with the intent to help customers intending to buy Tupperware products browse through the products’ range, create a wish list and facilitate flow of information to Tupperware authorized representative vizDistributors and Distributors’ Sales Force comprising of Managers and Consultants for them to take orders from the customers interested in buying Tupperware products and service the customers as per the defined distribution channel.

3. By sharing phone number and email address, user gives permission to Tupperware India to send them updates & offers related to their products & opportunity, through emails or SMS.

4. Creation of wish list doesn’t amount to placement of order. The orders are generated on acceptance of the wishlist by the authorized representative as per the processes which are defined in the URL – wishlist.tupperwareindia.com/faqs. The purchase of products shall be additionally guided by specific policies of sale like cancellation policy, return policy, replacement policy etc which are found in the URL – wishlist.tupperwareindia.com/faqs.

5. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Tupperware India owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to Tupperware India without obtaining authorization from Tupperware India.

6. The User agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the Website. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Website is not permitted.

7. You acknowledge that sensitive information will be sent by the Company through electronic media, and therefore, the email ID and the phone number as provided by you to the Company are correct and shall remain in force throughout your engagement within the Company’s distribution system.

8. You have authorized the Company to store the information provided by you on the Company’s server. The Company shall take due care not to disclose such data/information to third parties, except to such members of its staff to whom disclosure of information is necessary for performance of their duties.

9. All terms, conditions and warranties express or implied by custom, law or statute in any way relating to access to, or non-access to, this Site or use of, or reliance upon, this Site or the contents hereof are hereby excluded. The Company does not warrant expressly or impliedly that your access to the Site and (or any Site linked in any way to this Site) will be uninterrupted or error free. The Company also does not warrant expressly or impliedly that any defect(s) will be corrected or that the Site (or any Site linked in any way to this Site) or the server which stores or transmits content to you are free of viruses or any other harmful components.

The Company and/or any of its directors or employees or authorized Tupperware representativeshall in no event be liable for any direct, indirect, incidental, special and/or consequential damages, including loss of profits, arising out of any failure, disruption, downtime, interruption, mis-calculation, incorrect linkage, loss of data, delay, inaccuracy or any non-performance of the software or service or for any other loss or damage arising directly or indirectly from use of the software or service. In addition, the Company has no duty to update this Site or the content hereof and shall not be liable for any failure to update such information.

11. These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at New Delhi.

12. If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect

13. The User hereby consents, expresses and agrees that he has read and fully understands Privacy Policy of Tupperware India. The user further consents that the terms and contents of such Privacy Policy are acceptable to him.
